XBBIT (‘‘we’’) and handles your personal information in accordance with its legal obligations, including those under the Privacy Act 1988 (Cth). We is committed to protecting your personal information and being transparent about what information we hold. This notice tells you about why, what, how, and when we collect, process and use your personal data. Please read carefully this notice before you give us your consent.

Why do we collect personal information?

We collect, process, and use personal information for purpose of fulfilling our obligations under our services agreement with you to ensure the quality of the products and services we offer. The purposes can generally be described as below:

  1. Offering of any of the following services:

  2. Transactions between various digital currencies.

  3. Exchange transactions between digital currencies and Australian dollars or other fiat currency.

  4. Transfer in or out digital or fiat currency.

  5. Other relevant business permitted by the Competent Authority.

  6. For marketing purposes such as sending newsletters or marketing communications.

  7. Other purposes based on law, contracts or quasi-contracts and are limited to what is necessary or in connection with the purposes of customer service management.

The type of personal information we collect and process about you may include:

  1. Basic information such as name, ID number, gender, birth date, and identification(s) (e.g., copy of bio-data page of passport or a resident certificate);

  2. Contact details such as email address, permanent address, resident address, mailing address and phone number(s); Information provided by you during the course of our business relationship;

  3. Information on your credit score, tax record and proof of income;

  4. Digital information (e.g., IP address);

  5. Publicly available information (we may collect and handle information that is in the public domain, such as from online forums, websites, Facebook, Twitter, YouTube or other social media);

  6. Other information alike that helps fulfill the purpose for which it was collected;

  7. Other types of personal data collected to implement our anti-money laundering policy.

We collect your personal information directly from you most of the time, however on occasion, we may also collect information about you from other people and organizations.

While we are required to collect some types of personal information to meet our legal obligations, we do attempt to keep our collection of your personal information to what is necessary to offer you the products and services you require.

How do we process and use personal information?

  1. We will process your personal information by automated as well as manual means for purposes.

  2. We may share your personal information with other organizations within our group or third parties for the above purposes, including but not limited to cooperating banks, third party payment providers, system providers or other authorized third parties.

  3. We will have to disclose your personal data from time to time to supervisory authority(ies) where required by law.

  4. We reassure you that, we will, under no circumstances, sell your personal data to third parties or permit third parties to sell the data we have shared with them.

  5. Where data needs to be transferred outside the territory, we will ensure that all such transfers comply with the relevant data protection laws. Where transfers are to be made from the European Economic Area (EEA) to non-EEA countries, we will ensure due compliance with the data protection regulations of the European Union that adequate safeguards are in place.

  7. We aim to keep personal information only for as long as we need it – for example for business or legal reasons. When we no longer need information, we take reasonable steps to destroy or de-identify it.

Your rights

  1. Right to withdraw consent. Where your personal data is collected and processed by us based on your consent, you have the right to withdraw that consent at any time. If you withdraw consent, we may not be able to provide certain products or services to you. The right to withdraw only applies when the lawful basis of processing is consent.

    2. search, review your personal data

    3. copy your personal data;

    4. receive your personal data in a structured, commonly used and machine-readable format;

    5. demand rectification of incorrect or incomplete data;

    7. request deletion or removal of your personal data.

  3. You may, at your discretion, decide whether to provide us with your personal information. If you decide not to provide us with your personal information, we may not be able to provide you with the requested services.

  4. You have the right to lodge a complaint with the relevant data protection authority should you believe that we have violated your privacy right through inappropriate use of your personal data and have failed to promptly cure such violation upon receipt of your request for cure.

While we cannot guarantee that unauthorized access will never occur, rest assured that we make our best effort to ensure the security of your personal information through the use of appropriate technology and safeguards.

Data retention period

Except as otherwise required by applicable law, we endeavor to retain your personal data only for as long as is necessary for us to fulfill the aforementioned purposes. After the data retention period, we will destroy or delete your personal information or make it anonymous such that it cannot be identified or traced back to you.
